1. Agreement to Terms

By accessing or using HYR Pools Club services, website, or mobile applications (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Services.

2. Description of Services

HYR Pools Club provides:

• Virtual pool care membership with AI-powered support (NIKO AI)
• Chemical delivery services for residential pools
• Robotic pool cleaner rental programs
• Equipment protection plans (HYR Shield)
• Traditional and executive pool service options
• Technical support from certified pool technicians

3. Membership & Subscriptions

3.1 Billing: Memberships are billed on a recurring basis (monthly or annually) according to the plan you select. By subscribing, you authorize us to charge your payment method on a recurring basis.

3.2 Cancellation: You may cancel your membership at any time through your Stripe customer portal or by contacting us. Cancellations take effect at the end of your current billing period.

3.3 Refunds: Monthly memberships are non-refundable. Annual memberships may be eligible for a prorated refund within the first 30 days of purchase.

4. Service Area

Our delivery and on-site services are currently available in the Las Vegas Valley, including Henderson, Summerlin, North Las Vegas, and surrounding areas. Virtual membership benefits (NIKO AI, technical support) are available regardless of location.

5. Chemical Delivery

Chemical delivery subscriptions include scheduled deliveries based on your pool size. You are responsible for proper storage of chemicals in accordance with safety guidelines. HYR Pools is not liable for damage resulting from improper chemical storage or handling.

6. Equipment Rental

Robotic cleaner rentals remain the property of HYR Pools. You agree to use rental equipment only for its intended purpose and to report any damage or malfunction promptly. Normal wear and tear is covered; damage from misuse may result in repair or replacement charges.

7. HYR Shield Protection Plans

Shield plans cover equipment repairs and replacements as outlined in your specific plan tier. Coverage is subject to inspection and does not cover pre-existing conditions, cosmetic damage, or damage from improper water chemistry maintenance.

8. User Responsibilities

You agree to:

• Provide accurate account and pool information
• Maintain safe access to your pool area for service visits
• Follow chemical handling and safety guidelines
• Notify us of any changes to your pool or equipment
• Use the Services in compliance with all applicable laws

9. Limitation of Liability

To the maximum extent permitted by law, HYR Pools shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our Services. Our total liability shall not exceed the amount paid by you in the twelve (12) months preceding the claim.

10. Intellectual Property

All content, trademarks, and intellectual property on our website and Services are owned by HYR Pools or its licensors. You may not reproduce, distribute, or create derivative works without our express written permission.

11. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by email or through our website. Continued use of the Services after changes constitutes acceptance of the modified Terms.

12. Governing Law

These Terms are governed by the laws of the State of Nevada, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Clark County, Nevada.
